HPDI Technology Limited Partnership and HPDI Technology AB and their subsidiaries and affiliates (collectively, and as applicable, “HPDI Technology“) are committed to respecting the privacy of individuals and recognize the importance of these values to the people with whom we do business (partners, customers, suppliers, consultants).  In the course of our business, we collect, use and disclose personal information and have taken steps to help ensure the appropriate management and protection of any personal information that you agree to provide to us.

This policy describes:

  • how we collect, use, disclose, and protect the personal information of our customers and website users (“you“).
  • the types of information we may collect from you or that you may provide when you visit our websites (our “Website“).
  • our practices for collecting, using, maintaining, protecting, and disclosing that information.

We will only use your personal information in accordance with this policy unless otherwise required by applicable law. We take steps to ensure that the personal information that we collect about you is adequate, relevant, not excessive, and used for limited purposes.

Privacy laws generally define “personal information” as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. Personal information does not include business contact information, including your name, title, or business contact information.

Our management of personal information and commitment to complying with applicable laws includes guidelines on the collection, storage, use, disclosure and retention of your personal information as set out below.

This policy applies to personal information collected, used and disclosed by HPDI Technology which is not related to the duties and activities of employees, directors, officers, and third-party agents acting on behalf of HPDI Technology, which is dealt with in a separate policy.

Please read this policy carefully to understand our policies and practices for collecting, processing, and storing your information. If you do not agree with our policies and practices, your choice is not to use our Website. By accessing or using our Website, you indicate that you understand, accept, and consent to the practices described in this policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of our Website after we make changes indicates that you accept and consent to those changes, so please check the policy periodically for updates.

 

COLLECTION

Unless the purposes for collecting personal information are obvious and the client, customer, member voluntarily provides his or her personal information for those purposes, HPDI Technology will communicate the purposes for which personal information is being collected, either orally or in writing, before or at the time of collection.

Generally, HPDI Technology collects personal information about individuals (employees, partners, customers, suppliers, consultants, etc.) in order to better manage its business.

We collect and maintain different types of personal information in respect of the individuals with whom we interact. This includes:

  1. your contact information, which may include, but is not limited to: name, email address and telephone number;
  2. technical information, including your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, or information about your internet connection, the equipment you use to access our Website, and usage details;
  3. non-personal details about your Website interactions, including the full Uniform Resource Locators (URLs), clickstream to, through and from our Website (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, or any phone number used to call our customer service number;
  4. log data, which may include, but is not limited to: Internet Protocol (IP) address, browser type, operating system, the web page that you visited before accessing our Services, the pages or features of our Services to which you browsed and the time spent on those pages or features, search terms, the links on our Services that you clicked on and other statistics;
  5. product and service related information concerning the products and services that we provide to, or receive from, you; and
  6. any other information described in this policy.

We use different methods to collect your information, including through:

  • Direct interactions with you when you provide it to us, for example, by filling in forms or corresponding with us by phone, email, or otherwise.
  • Automated technologies or interactions, as you navigate through our Website. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
  • When you interact with our advertising and applications on third-party websites and services if those applications or advertising include links to this policy.

As you navigate through and interact with our Website, we may use cookies or other automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns all of which is described further in our Cookie Policy.

HPDI Technology collects personal information reasonably necessary for the following purposes:

  • To provide you with information, products, or services that you request from us;
  • To tailor and improve the experience you have on our Website through the use of cookies, and to provide us with analytics regarding website visits, all of which is described further in our Cookie Policy;
  • To meet regulatory and reporting requirements; and
  • Such other purposes identified at the time of collection or as required or permitted by law.

HPDI Technology will limit the collection and use of personal information to that required for legitimate business purposes or to comply with the law.

 

CONSENT

HPDI Technology will obtain consent to collect, use or disclose personal information except where we are authorized by law to do so without consent. Consent may be express, deemed, or implied. Consent may be implied in the circumstances, such as where the individual voluntarily discloses the information when the purpose would be obvious to the individual. Implied consent may also be appropriate where an individual is given notice of the purpose for collection, use or disclosure of their personal information and does not opt-out.

Subject to exceptions, such as when personal information is necessary to satisfy a legal requirement or provide the service or product, individuals may withdraw their consent. The withdrawal of consent may restrict our ability to provide a particular service or product.

HPDI Technology may collect, use or disclose personal information in some circumstances without the knowledge or consent of the individual in accordance with the law. Some examples include where the information is available from a public source, to collect a debt, for fraud prevention or security purposes, and to investigate an anticipated breach of HPDI Technology policies, an agreement, or the law.

 

SECURITY AND STORAGE

HPDI Technology is committed to ensuring the security of personal information to protect it from unauthorized access, collection, use, disclosure, copying, modification or disposal or similar risks.  HPDI Technology takes reasonable steps to safeguard personal information through suitable measures considering the sensitivity of the information, including the following as appropriate:

  • physical measures such as locked drawers or filing cabinets;
  • organizational measures such as restricting access to systems, files and records, or permitting role based access to personal information by designated individuals; and
  • computer security measures such as encryption and/or password protection.

In addition to the care that HPDI Technology takes directly, we also work with our partner organizations that may at some point handle personal information gathered by us in the course of their relationship with, and service to, us. Each third party partner has agreed to meet our standards of privacy, confidentiality, and security.

We will routinely review and update our privacy and security policies and controls as technology changes to ensure ongoing personal information security. We reserve the right to change and update our policies, so please refer to this website for updates to this Privacy Statement.

 

RETENTION

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent. HPDI Technology will retain personal information for at least one year after it has been used to make a decision about an individual.

 

DISCLOSURE

HPDI Technology will not sell personal information to third parties without consent. However, we reserve the right to transfer personal information to an affiliated company or in the case of an amalgamation, merger or sale of substantially all the assets of HPDI Technology.

HPDI Technology may collect, use and disclose personal information outside of Canada where there are reasonable business purposes for doing so and in compliance with applicable privacy legislation. In these circumstances, your personal information may be transferred in and to a foreign country, with different privacy laws that may or may not be as comprehensive as Canadian law, and, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country. HPDI Technology may share information with Westport Fuel Systems Canada Inc., based in Vancouver, Canada, Volvo AB, based in Sweden and other affiliates located in Europe and China. HPDI Technology also shares information with contractors, service providers, and other third parties we use to support our business (such as various service providers to host our server and platforms which are located in the United States and also in Europe) and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this policy.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request, in accordance with applicable law.
  • To enforce or apply our terms of use or terms of sale and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of HPDI Technology, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

 

ACCURACY & ACCESS

HPDI Technology will make every reasonable effort to ensure that the personal information it collects and uses is accurate and complete when being used to make a decision about the individual. Individuals have a right to access their personal information and to correct their personal information in order to ensure its accuracy and completeness, subject to limited exceptions. A request to review, verify, correct, or withdraw consent to the use of your personal information that you have provided to us must be made in writing to the Privacy Officer identified below and provide sufficient detail to identify the personal information being sought. HPDI Technology may charge a reasonable fee for providing access to personal information. Where a fee may apply, we will advise you in advance and request further direction on whether or not we should proceed with the request.

We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the personal information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, erased, or made your personal information anonymous in accordance with our record retention obligations and practices. If a request is refused in full or in part, we will inform you in writing of the reasons why, subject to any legal or regulatory restrictions.

Where you have provided your consent to the collection, use, and transfer of your personal information, you may have the legal right to withdraw your consent under certain circumstances. To withdraw your consent, if applicable, please contact the Privacy Officer identified below. Please note that if you withdraw your consent we may not be able to provide you with a particular product or service. We will explain the impact to you at the time to help you with your decision.

CHILDREN UNDER THE AGE OF 13

Our Website is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Website. We do not knowingly collect personal information from children under 13. If you are under 13, do not provide any information about yourself to us, including your name, address, telephone number, email address, or any user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact the HPDI Technology Corporate Privacy Officer as set out above.

 

CHANGES TO OUR PRIVACY POLICY

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat your personal information, we will notify you through a notice on the Website home page.

We include the date the privacy policy was last revised at the top of the page. You are responsible for periodically visiting our Website and this privacy policy to check for any changes.
